Thank you for using Myomelt. Our Privacy Statement, contained in the pages that follow, serves to give you notice about the types of personal information we collect, how we use it, who we share it with and why, and what we do to protect it. We encourage you to read the full statement carefully. In the meantime, we provide a quick overview below.

What do we collect?

There are two types of information we obtain from you and store: (i) non-personal information collected automatically from each visitor, such as your device type and IP address; and (ii) personal information that you voluntarily provide to us or that is collected automatically when you use our Services.

Why do we use it?

We use your information to operate and deliver the Services, process payments, communicate with you, send you marketing communications you have consented to receive, improve our programs, and for the other purposes described in full below. We do not sell or rent your personal information to third-party data brokers or marketing companies.

When do we share it?

We share personal information with service providers and platform partners who help us deliver the Services, when required by law, and in connection with business transfers. We do not sell your personal information to third parties for their own marketing purposes. Content you voluntarily post in any Myomelt community may be used by Myomelt for marketing purposes as described in our Terms of Service and in this Statement.

Your Privacy Choices and Rights

You do not have to provide personal information beyond what is required to use the Services. You can opt out of marketing emails and SMS messages at any time. Depending on where you reside, you may have additional rights under applicable data protection law. See the sections below for details.

A Note on Health Information

Your identification as a Myomelt user or participant in any Myomelt program may imply that you have an interest in exercise for health or pain management purposes. If you wish to avoid that implication, do not use the Services. Additionally, if you voluntarily share health information in any Myomelt community, that information is public and visible to other participants. Do not share health information you are not comfortable making publicly available.

SECTION 1 — WHO WE ARE AND SCOPE OF THIS STATEMENT

Myomelt LLC (“Myomelt,” “we,” “us,” or “our”) is a New York limited liability company that operates an online fitness and exercise platform. We use the words “you” and “your” to mean you, the reader, and other visitors to and users of our Services who are in all cases over the age of 18.

This Privacy Statement (“this Statement”) describes how Myomelt collects, uses, stores, shares, and protects personal information in connection with all Myomelt services, including: the myomelt.com website, the Myomelt mobile application, subscription membership programs, standalone challenges, webinars, seminars, educational programs, coaching sessions (group and individual), member and participant communities, and any other programs, products, or services offered by Myomelt, whether free or paid, recurring or one-time (collectively, the “Services”).

This Privacy Statement is incorporated by reference into Myomelt's Terms of Service. By using any Service, you agree to the terms of this Statement and consent to the collection, use, and sharing of your information as described herein. If you do not agree with any part of this Statement, please do not use the Services.

This Statement describes our practices as of the effective date above and covers our practices over the preceding 12 months.

SECTION 2 — WHO WE COLLECT PERSONAL INFORMATION FROM

We may collect personal information from the following groups:

  • Visitors to and users of our website and mobile application;

  • Subscribers to our membership programs;

  • Participants in any Myomelt challenge, webinar, seminar, educational program, coaching session, or other standalone program or promotional event;

  • Members of any Myomelt community, whether associated with a subscription or a standalone program;

  • Individuals who contact us directly by email, phone, form submission, or social media; and

  • Individuals who interact with our marketing materials, advertisements, or social media content.

Personal information generally means information that can be used to identify you or that can be easily linked to you. In jurisdictions with specific data privacy laws — such as the California Consumer Privacy Act (“CCPA”) or the EU General Data Protection Regulation (“GDPR”) — our use of the phrase “personal information” includes the unique elements required by those laws.

SECTION 3 — WHAT WE COLLECT

3.1 Voluntarily Submitted Information

When you register for an account, purchase or register for any Service, contact us, or participate in any Myomelt community or program, you may provide us with personal information including:

  • Identifiers: your full name, email address, phone number, and mailing address;

  • Account credentials: username and password;

  • Payment and billing information: billing address and payment method details, which are submitted to and processed by our third-party payment processors (see Section 7);

  • Profile information: any additional information you voluntarily add to your profile, such as fitness goals or experience level;

  • Communications: records of your correspondence with us, including emails, support requests, and form submissions;

  • Community and program content: posts, comments, progress updates, photos, videos, testimonials, before-and-after content, and any other content you share in any Myomelt community or program setting (see Section 4 for more detail); and

  • Health and wellness information: any health, medical, or physical condition information you choose to voluntarily share through any Service (see Section 4).

If you do not want us to collect certain types of personal information, do not provide it. Not providing certain information may limit your ability to use some features of the Services.

3.2 Automatically Collected Information

When you visit our website or use our mobile application, certain information is automatically collected through your browser or device, including:

  • Technical identifiers: IP address, device type, operating system, browser type and version, and mobile device identifiers;

  • Usage data: pages visited, features accessed, content viewed, time spent, click patterns, referring URLs, and search queries within the Services;

  • Approximate location: geographic location derived from your IP address; and

  • Cookie and tracking data: information collected through cookies and similar technologies, described further in Section 9.

Additionally, if you access our Services from a mobile device, your mobile service provider may transmit device identification information to us. Some mobile devices also transmit location data; if you do not want us to collect geolocation data, disable location services through your device settings.

3.3 Information Received from Third Parties

We may receive information about you from third-party platforms and service providers we use to operate the Services, including transaction confirmation and account data from our payment processors, usage and engagement data from our platform hosting providers, and interaction data from our marketing and analytics platforms. We may also receive information if you interact with our advertising or social media content on third-party platforms.

SECTION 4 — COACHING SESSIONS, VIRTUAL PROGRAMS, AND COMMUNITY CONTENT

4.1 Coaching Sessions and Virtual Programs

Myomelt’s Services include live and recorded coaching sessions and virtual programs, which may be conducted in a group format or on an individual one-on-one basis (“Coaching Sessions”). These sessions are facilitated by Myomelt coaches and may permit your voice, image, and likeness to be shared with the coach and, in group sessions, with other participants through video and audio communication.

ALL COACHING SESSIONS AND VIRTUAL PROGRAMS MAY BE RECORDED AT ANY TIME. By registering for, joining, or participating in any Coaching Session or virtual program in any format — whether group or individual — you acknowledge and consent to being recorded. You do not need to receive separate advance notice of recording before each session; this Statement and the Terms of Service serve as your notice that recording may occur in any session at any time. Recordings are made available as replays to current program participants and may also be retained and used by Myomelt for training, quality assurance, content development, and marketing purposes, consistent with this Statement and the Terms of Service. If you do not wish to appear on camera or have your audio captured, you may participate with your camera and microphone disabled.

Coaching Sessions are exercise-based programs only and do not constitute medical advice, physical therapy, or any other licensed healthcare service, regardless of the professional credentials of the coach. Please review Section 4 of our Terms of Service for the full medical disclaimer.

4.2 Community Forums and Public Content

Our Services include communities and forums associated with subscription memberships, challenges, webinars, seminars, and other programs (“Community”). When you participate in any Community, you may share content including posts, comments, questions, progress updates, photos, videos, and other materials (collectively, “User Content”).

ALL USER CONTENT YOU POST IN ANY MYOMELT COMMUNITY IS PUBLIC AND VISIBLE TO OTHER PARTICIPANTS IN THAT COMMUNITY. Myomelt has no practical ability to control what other participants do with content you post publicly, including taking screenshots or sharing it outside the community. You choose and control what information you share in any Community, and you share it at your own risk.

4.3 Voluntarily Shared Health Information

Many Myomelt participants voluntarily share personal health information in Community posts and during Coaching Sessions, including information about health conditions, injuries, surgical history, medications, and physical limitations. This is entirely voluntary. We collect, store, and may use voluntarily shared health information as described in this Statement.

YOUR IDENTIFICATION AS A MYOMELT USER OR PROGRAM PARTICIPANT MAY IMPLY THAT YOU HAVE AN INTEREST IN EXERCISE FOR HEALTH OR PAIN MANAGEMENT PURPOSES. IF YOU WISH TO AVOID THAT IMPLICATION, DO NOT USE THE SERVICES. IF YOU DO NOT WANT INFORMATION ABOUT YOUR HEALTH CONDITIONS OR OTHER SENSITIVE PERSONAL INFORMATION TO BE USED OR DISCLOSED AS DESCRIBED IN THIS PRIVACY STATEMENT, DO NOT PROVIDE SUCH INFORMATION AND DO NOT POST IT IN ANY MYOMELT COMMUNITY.

To the extent that your voluntarily shared health information constitutes sensitive personal data or a special category of personal data under applicable law, your voluntary and public posting of such information in a Community constitutes your explicit consent to the collection and processing of that information as described in this Statement.

SECTION 5 — HOW WE USE YOUR INFORMATION

We use personal information we collect for the following purposes:

5.1 To Provide and Operate the Services

  • To process registrations, purchases, and subscription enrollments for all Services, including challenges, webinars, seminars, and other programs;

  • To provide access to content, coaching sessions, communities, and other features of the Services;

  • To process payments and send purchase confirmations, invoices, and receipts;

  • To create, manage, and administer your account;

  • To facilitate and record coaching sessions and make recordings available to participants; and

  • To respond to your questions, support requests, and other communications.

5.2 To Communicate with You

  • To send you transactional and account-related communications, including billing notices, program access confirmations, and account security alerts;

  • To send you program updates, coaching session reminders, and other service communications; and

  • To send you marketing and promotional communications by email and SMS/text message, where you have provided consent (see Section 8).

5.3 To Improve and Develop the Services

  • To understand how users interact with and use the Services;

  • To analyze usage patterns and measure the effectiveness of our content and programs;

  • To develop new features, programs, and Services; and

  • To conduct internal research and analysis.

5.4 For Marketing and Advertising

  • To use User Content you have posted in any Myomelt community or submitted through any Service for marketing, advertising, and promotional purposes, as described in Section 10 and in the Terms of Service;

  • To deliver targeted advertising on third-party platforms based on your interactions with the Services; and

  • To analyze the effectiveness of our advertising campaigns.

5.5 For Legal, Safety, and Compliance

  • To comply with applicable laws, regulations, and legal obligations;

  • To protect the rights, property, and safety of Myomelt, its users, and others;

  • To prevent, detect, and investigate fraud, abuse, and violations of our Terms of Service; and

  • To enforce our Terms of Service and other agreements.

SECTION 6 — WHEN AND WITH WHOM DO WE SHARE PERSONAL INFORMATION?

We do not sell or rent your personal information to third-party data brokers or marketing companies. We may share your personal information in the following circumstances:

6.1 Service Providers and Platform Partners

We share personal information with third-party service providers and platform partners who assist us in operating the Services and conducting our business. These providers are permitted to use your personal information only as necessary to perform services on our behalf. The specific platforms we currently use to deliver the Services are described in Section 7.

6.2 Marketing Use of User Content

As described in Section 10 of this Statement and in Section 10.3 of our Terms of Service, User Content you voluntarily post in any Myomelt community or submit through any Service may be used by Myomelt for marketing and promotional purposes. This includes sharing your content publicly in advertising, on our website, on social media, and in other promotional contexts. This constitutes a form of disclosure of your User Content to the public and to prospective customers. Please review Section 10 below and Section 10.3 of the Terms of Service carefully.

6.3 Advertising and Analytics Partners

We may share certain information — including identifiers, device data, and usage data — with advertising networks, analytics providers, and social media platforms for the purpose of delivering targeted advertising and measuring the effectiveness of our marketing. This may include sharing data with platforms such as Meta (Facebook/Instagram) and Google through pixel and tag technologies. These disclosures may constitute a “sale” or “sharing” of personal information under certain state privacy laws. See Section 17 for more information and opt-out options.

6.4 Legal Requirements and Protection of Rights

We may disclose your personal information if we believe in good faith that such disclosure is necessary to: (a) comply with applicable law, regulation, subpoena, or court order; (b) respond to requests from government or law enforcement authorities; (c) protect the rights, property, or safety of Myomelt, its users, or others; or (d) enforce our Terms of Service or other agreements.

6.5 Business Transfers

In connection with any merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our assets or business, your personal information may be transferred to or shared with the relevant third party. We will use reasonable efforts to notify you of any such transfer by updating this Statement.

6.6 With Your Consent

We may share your personal information with third parties in other circumstances where you have given your express prior consent.

SECTION 7 — THIRD-PARTY PLATFORMS AND SERVICE PROVIDERS

Myomelt uses third-party platforms and service providers across several categories to deliver and operate the Services. Each provider has its own privacy practices and terms of service that may apply to your interaction with those platforms. Myomelt may add, change, or replace service providers at any time; the categories below describe the types of providers we use and will continue to reflect our practices as those relationships evolve.

The categories of service providers we use include:

  • Payment processing: providers who handle payment card transactions and payment authentication on our behalf. Your payment information is submitted directly to and processed by these providers; Myomelt does not store your full payment card number. These providers are certified to applicable payment card security standards.

  • Platform hosting and community: providers who host our membership platform, content library, and member and participant communities, and who collect usage and account data about platform users.

  • Video hosting and delivery: providers who host, encode, and deliver video content to you when you access Myomelt programs. These providers may collect technical data about your video viewing activity.

  • Session recording and video conferencing: providers who facilitate live coaching sessions and virtual programs, including any recording of those sessions. All sessions may be recorded as described in Section 4.1.

  • Scheduling and appointment management: providers who manage scheduling for coaching sessions and other appointments.

  • Marketing, sales, and funnel management: providers who host and operate our registration pages, sales pages, and marketing funnels. Information you submit on these pages, including your name, email, and phone number, is shared with Myomelt.

  • Email and SMS communications: providers who send and manage email and text message communications on our behalf. These providers have access to your email address and phone number solely to deliver communications and are not permitted to use that information for their own marketing purposes.

  • Customer relationship management: providers who help us manage customer records, communications history, and support interactions.

7.1 Analytics and Advertising Platforms

We specifically disclose the following analytics and advertising platforms by name because their data practices are most relevant to your privacy choices and your rights regarding targeted advertising:

  • Google Analytics: a web analytics service operated by Google LLC that uses cookies to help us analyze how users interact with our Services. Information generated by cookies about your use of the Services may be transmitted to and stored by Google. For information on how Google uses this data, visit policies.google.com/technologies/partner-sites. To opt out of Google Analytics, visit tools.google.com/dlpage/gaoptout. Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use Requirements.

  • Meta Pixel (Facebook/Instagram): a tracking technology operated by Meta Platforms, Inc. that we use to measure the effectiveness of our advertising, build advertising audiences, and deliver targeted advertisements on Meta’s platforms. The Meta Pixel may collect information about your interactions with our website and associate that information with your Meta account if you are logged in.   • Google Ads: conversion tracking and audience tools operated by Google LLC that we use to measure advertising effectiveness and deliver targeted advertisements across Google’s advertising network.

You may opt out of interest-based advertising from these and other participating companies through the Digital Advertising Alliance at optout.aboutads.info, the Network Advertising Initiative at optout.networkadvertising.org, or your browser’s privacy settings. California residents and users in other applicable jurisdictions may also opt out through the mechanisms described in Section 17.

SECTION 8 — SMS AND TEXT MESSAGE MARKETING

By providing your mobile phone number to Myomelt through any website, registration form, or other property and indicating your consent to receive text messages, you expressly consent to receive recurring automated and/or manual marketing, promotional, and transactional text messages (SMS and MMS) from Myomelt LLC at the mobile phone number you provided. Your consent to receive text messages is not required as a condition of purchasing any product or Service.

Message frequency varies depending on your account activity and the Services you use. Standard message and data rates may apply as determined by your mobile carrier. Not all mobile devices or carriers may be supported. Messages may be delayed or undelivered for various reasons. Myomelt will not be liable for any delays or failures in your receipt of any messages.

You may text HELP for customer support information or STOP to cancel at any time. After texting STOP, you will receive one final confirmation message. To resume receiving messages, you may text START or re-opt-in through our website or a contact form.

We may share your mobile number with service providers who assist us in delivering text messages, but we do not sell or share your mobile number with third-party marketers. You acknowledge that you are the account holder for the mobile phone number you provided, or that you have the account holder’s permission to opt in to receive messages at that number. Carriers are not liable for delayed or undelivered messages.

SECTION 9 — COOKIES AND TRACKING TECHNOLOGIES

When you visit our website or use our mobile application, information is passively collected through your browser via cookies and similar tracking technologies.

9.1 What Are Cookies

Cookies are small data files stored on your device when you visit a website. Each device that accesses our website is assigned a cookie that allows us to recognize your device, store your preferences, and understand how you use our Services.

9.2 Types of Cookies We Use

  • Session cookies: specific to a particular visit and carry information as you move through different pages. Session cookies expire and delete automatically when you close your browser or leave the Services.

  • Persistent cookies: stored on your device until you delete them or they expire. Persistent cookies allow us to recognize you on return visits and remember your preferences, such as keeping you signed into your account.

9.3 Third-Party Cookies and Tracking

We allow third-party vendors to use cookies and similar technologies to collect information about your browsing activities over time and across websites. This includes Google Analytics, which uses cookies to help us analyze how you use our Services. For information on how Google uses this data, visit policies.google.com/technologies/partner-sites. Our use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use Requirements.

We also use advertising pixels from Meta and other platforms that collect information about your interactions with our website and advertisements for the purpose of delivering targeted advertising and measuring campaign performance.

9.4 Your Cookie Choices

You may be able to refuse or disable cookies through your browser settings. Disabling cookies may limit your ability to use some features of the Services. You may also opt out of certain interest-based advertising through the Digital Advertising Alliance at optout.aboutads.info or the Network Advertising Initiative at optout.networkadvertising.org.

SECTION 10 — MARKETING USE OF USER CONTENT

BY POSTING ANY CONTENT IN ANY MYOMELT COMMUNITY OR VOLUNTARILY SUBMITTING ANY CONTENT TO MYOMELT THROUGH ANY CHANNEL IN CONNECTION WITH ANY SERVICE, YOU GRANT MYOMELT AND ITS AFFILIATES, LICENSEES, SUCCESSORS, AND ASSIGNS A PERPETUAL, WORLDWIDE, ROYALTY-FREE, IRREVOCABLE, NON-EXCLUSIVE, SUBLICENSABLE LICENSE TO USE, REPRODUCE, SCREENSHOT, DISPLAY, DISTRIBUTE, MODIFY, ADAPT, PUBLISH, TRANSLATE, AND CREATE DERIVATIVE WORKS FROM YOUR CONTENT FOR ANY COMMERCIAL, MARKETING, PROMOTIONAL, OR ADVERTISING PURPOSE, IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVISED, WITHOUT FURTHER NOTICE, WITHOUT COMPENSATION, AND WITHOUT YOUR FURTHER CONSENT.

This applies to all forms of User Content, including posts, comments, progress updates, testimonials, before-and-after photos, videos, and any other content shared in any Myomelt community associated with any Service — including subscription member communities, challenge communities, webinar and seminar communities, and coaching program communities. It applies equally to subscribers, challenge participants, webinar attendees, seminar participants, and all other program participants.

In plain terms: if you post a progress update, a testimonial, a before-and-after photo, or any other content in any Myomelt community, Myomelt may screenshot it and use it in advertisements, on social media, on our website, in emails, and in other marketing materials. By participating in any Myomelt community, you are agreeing to this use. If you do not wish to grant this license, do not post content in Myomelt communities.

The full terms of this license are set forth in Section 10.3 of the Myomelt Terms of Service, which is incorporated into this Statement by reference. The license you grant is irrevocable and survives your cancellation of any subscription or discontinuation of any Service.

SECTION 11 — DATA SECURITY

We employ industry-standard administrative, physical, and technical measures designed to safeguard and protect your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. These measures include HTTPS encryption for data transmission, access controls limiting internal access to personal information, and reliance on reputable third-party service providers with their own security certifications.

The safety and security of your information also depends on you. You are responsible for keeping your account password confidential. Do not share your password with anyone. If you believe your account has been compromised, contact us immediately at [email protected].

UNFORTUNATELY, THE TRANSMISSION OF INFORMATION OVER THE INTERNET AND MOBILE PLATFORMS IS NOT COMPLETELY SECURE. MYOMELT CANNOT GUARANTEE THE SECURITY OR CONFIDENTIALITY OF YOUR PERSONAL INFORMATION. ANY TRANSMISSION OF PERSONAL INFORMATION IS AT YOUR OWN RISK. WE ARE NOT RESPONSIBLE FOR CIRCUMVENTION OF ANY PRIVACY SETTINGS OR SECURITY MEASURES WE PROVIDE.

We will make all legally required disclosures of any data breach that affects your personal information.

SECTION 12 — DATA RETENTION

Unless you request that we delete it, we will retain your personal information for as long as you use the Services or as long as necessary to fulfill the purposes for which it was collected, including to provide the Services, process transactions, resolve disputes, enforce our agreements, conduct audits, and comply with applicable laws. Specific retention considerations include:

  • Account and registration information is retained while your account is active and for a reasonable period thereafter.

  • Transaction and billing records are retained for a minimum of seven (7) years to comply with applicable tax and accounting laws.

  • User Content you have posted in any Myomelt community may be retained by Myomelt and used for marketing purposes indefinitely under the irrevocable license described in Section 10, even after you cancel your subscription or discontinue use of the Services.

  • Coaching session recordings are retained at Myomelt’s discretion for as long as they serve a legitimate business purpose.

  • Marketing consent records, including SMS and email opt-in and opt-out records, are retained as long as necessary to document consent and comply with applicable marketing laws.

When personal information is no longer needed for any applicable purpose, Myomelt will take reasonable steps to securely delete or de-identify it.

SECTION 13 — LOCATION OF DATA

Myomelt and our service providers’ servers containing personal information are located in the United States. If you are located outside of the United States — including in Canada, the European Economic Area, or the United Kingdom — your personal information is transferred to and processed in the United States in compliance with this Statement. By using our Services, you consent to such transfer, storage, and processing in the United States and acknowledge that we must process your personal information in the United States in order to deliver the Services. Please be advised that the United States may not afford the same level of data protection as is required in your own country.

SECTION 14 — CHILDREN’S PRIVACY

The Services are not designed or intended for children under 18 years of age, and we do not knowingly collect personal information from anyone under 18. If you are under the age of 18, you may not register for or use any Service. If we learn that we have collected or received personal information from a person under 18, we will take steps to delete that information and terminate that registration as promptly as possible. If you believe we might have any information from or about a child under 18, please contact us at [email protected].

SECTION 15 — THIRD-PARTY LINKS

The Services may contain links to third-party websites or services that are not owned or operated by Myomelt. We are not responsible for the privacy practices or content of third-party websites and do not control them. We encourage you to review the privacy policies of any third-party websites you visit. The inclusion of any link does not imply Myomelt’s endorsement of the linked site. You visit linked third-party sites at your own risk.

SECTION 16 — YOUR RIGHTS AND OPTIONS

Depending on where you reside, you may have certain rights with respect to your personal information. Regardless of your location, you have the following choices:

  • Opt out of marketing emails: click the “unsubscribe” link in any Myomelt marketing email or email us at [email protected].

Additional rights that may be available to you depending on your jurisdiction are described in Sections 17, 18, and 19. We will not discriminate against you for exercising any of these rights. We do not charge a different price or provide a different level of service based on you exercising your privacy rights.

To verify your identity before processing any request, we may ask you to provide identifying information that we will match to our records. Only you or a person you authorize in writing may make a verifiable request related to your personal information.

SECTION 17 — U.S. STATE DATA PRIVACY LAWS (INCLUDING CALIFORNIA CCPA/CPRA)

This section applies to residents of California and other U.S. states with applicable data privacy laws. The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, “CCPA”), provides California residents with specific rights regarding their personal information. Other states including Colorado, Connecticut, Virginia, Texas, and others have enacted similar laws. We describe our practices here to comply with all applicable U.S. state data privacy laws.

17.1 Categories of Personal Information We Collect

In the preceding 12 months, Myomelt has collected the following categories of personal information: (1) Identifiers (name, email, phone, IP address, account credentials); (2) Commercial information (purchase history, subscription records, program registrations); (3) Internet or other electronic network activity (browsing and usage data within the Services); (4) Sensory data (audio and visual information from coaching session recordings); (5) Health and wellness information voluntarily provided by users; and (6) Geolocation data derived from IP addresses.

17.2 Sale or Sharing of Personal Information

Myomelt does not sell your personal information to third parties for monetary consideration. However, our use of third-party advertising pixels and analytics tools (such as Meta Pixel and Google Ads) may constitute “sharing” personal information for cross-context behavioral advertising purposes under the CCPA and similar state laws. The categories of personal information involved include identifiers, internet activity data, and geolocation data; and the categories of recipients include companies that operate advertising and analytics technologies.

To opt out of the sharing of your personal information for cross-context behavioral advertising, you may: (a) use the Global Privacy Control signal from a compatible browser; (b) contact us at [email protected] to submit an opt-out request; or (c) use the opt-out links provided by the Digital Advertising Alliance and Network Advertising Initiative referenced in Section 9.4.

17.3 Your Rights Under State Privacy Laws

You may have the following rights, where applicable under the laws of your state:

  • Right to Know: the right to know what categories and specific pieces of personal information we have collected about you, the categories of sources, the purposes for collection and use, and the categories of third parties with whom we have shared your information.

  • Right to Correct: the right to request correction of inaccurate personal information.

  • Right to Delete: the right to request deletion of your personal information, subject to certain legal exceptions.

  • Right to Opt Out of Sale/Sharing: the right to opt out of the sale or sharing of your personal information for targeted advertising purposes.

  • Right to Limit Sensitive Personal Information: the right to limit Myomelt’s use of sensitive personal information, including health information, to those uses necessary to provide the Services.

  • Right of Non-Discrimination: the right not to receive discriminatory treatment for exercising any of these rights.

You may exercise these rights up to two times per 12-month period. If you wish to appeal a decision we make in response to a rights request, please contact us at the email address above within a reasonable time after receiving our response.

17.4 Authorized Agents

California and other state residents may designate an authorized agent to submit a rights request on their behalf. To use an authorized agent, you must provide written authorization signed by you, and we may also require you to verify your identity directly with us before we act on the request.

SECTION 18 — THE EU GENERAL DATA PROTECTION REGULATION AND UK GDPR

We do collect or otherwise obtain personal information from data subjects located in the European Economic Area (“EEA”) and the United Kingdom (“UK”). This section describes how we comply with the GDPR and UK GDPR for personal information collected from visitors to and users of our Services while they were in a GDPR Jurisdiction. For purposes of this section, “you” means only such GDPR Jurisdiction-based visitors and users.

18.1 Lawful Bases for Processing

Myomelt processes personal data on the following lawful bases under the GDPR: (a) Performance of Contract — processing necessary to provide the Services you have purchased or registered for; (b) Legitimate Interests — processing necessary for our legitimate business interests, including improving the Services, security, and fraud prevention, where those interests are not overridden by your rights; (c) Consent — where you have given explicit consent, including for SMS marketing, email marketing, and the collection and use of voluntarily shared health information posted publicly in our communities; and (d) Legal Obligation — where processing is required to comply with applicable law.

18.2 Cross-Border Data Transfers

If we transfer personal data from the GDPR Jurisdictions to a location outside the EEA or UK that has not been deemed adequate by the European Commission or UK authorities, we do so using approved transfer mechanisms, including Standard Contractual Clauses (SCCs) and where applicable the UK Addendum.

18.3 Your GDPR Rights

With respect to personal data collected from you while you were in a GDPR Jurisdiction, you have the following rights: transparency, access, rectification, erasure, restriction of processing, data portability, and objection. SECTION 19 — RIGHTS OF DATA SUBJECTS IN OTHER JURISDICTIONS (CANADA — PIPEDA)

This section applies to residents of Canada. The Personal Information Protection and Electronic Documents Act (“PIPEDA”) and applicable provincial privacy legislation govern the collection, use, and disclosure of personal information in Canada. Myomelt collects, uses, and discloses your personal information only for the purposes identified in this Statement and only with your knowledge and consent, or as permitted or required by law.

Canadian residents have the right to access personal information held about them by Myomelt and to request correction of any inaccurate information. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada at priv.gc.ca or your applicable provincial privacy commissioner.

In other jurisdictions with similar data privacy regulations, we collect and manage personal data in compliance with applicable local law. We do not sell personal information to third parties, and we do not use it for automated decision-making.

We will notify you of material changes by posting the updated Statement on our website with a revised effective date and, where required by applicable law, by sending an email notification to registered users.
